Terms of Service

These Terms of Service apply to all photography services and website usage provided by Wieteke Konings (“photographer”, “we”, “us”), unless otherwise agreed in writing.

1. Services
The photographer provides photography services as agreed during booking. The scope, date, time, location, and deliverables will be confirmed via email, invoice, or signed agreement.
2. Booking & Payment
A booking is only confirmed once the required deposit has been paid.
The remaining balance must be paid before delivery of the final gallery or digital files.
For services booked without a deposit, full pre-payment may be required.
3. Travel Costs
Travel expenses are charged at €0.30 per kilometer (excl. VAT) calculated from postal code 5741CA, unless otherwise stated. Additional travel expenses such as parking, permits, flights, hotel or toll fees may be added when applicable.
4. Delivery Time
Estimated delivery time for digital galleries will be communicated for each service type.
Photo albums, if included or purchased, are delivered within 6–8 weeks after the entire final gallery has been delivered, unless production or supplier delays occur.
Delivery timelines are estimated, not guaranteed.
5. Cancellations, Rescheduling & Refunds
Cancellations must always be submitted in writing.
Deposits are non-refundable, as the date and preparation time are reserved exclusively.
If rescheduling is possible, the photographer will try to accommodate a new date, but cannot guarantee availability or pricing.
For events, branding sessions, portraits or studio days, percentage-based cancellation fees may apply depending on the time of cancellation before the service date.
6. Copyright & Usage Rights
All images remain the copyright of the photographer.
Clients receive a non-exclusive, non-transferable license for personal or business use depending on the booked service.
Images may not be sold, altered with AI tools, used for contests, commercial campaigns, or provided to third parties unless written permission is granted.
The photographer may use images for portfolio, website, social media, and promotional purposes unless the client requests otherwise in writing before the shoot.
7. Liability
The photographer is not liable for circumstances beyond control, including but not limited to: weather, venue restrictions, equipment malfunction, illness, technical issues, acts of third parties, or client no-shows.
Back-up procedures will be followed, and if the photographer is unable to attend due to illness or emergency, a qualified replacement will be arranged if possible.
8. Client Cooperation
Clients agree to cooperate, arrive on time, and follow instructions necessary for successful results.
The photographer is not responsible for subject appearance, clothing, styling, weather, or location limitations.
9. Complaints
Concerns or complaints must be submitted within 14 days after delivery.
We will review and respond with the intent to find a fair solution.
10. Governing Law
All services, agreements, and disputes are governed by Dutch law.
Where possible, conflicts will first be addressed by communication and mediation.
